Chapter 6 - The Legal Confrontation

I immediately retained one of the top family and civil litigation attorneys in the city, a sharp, no-nonsense woman named Victoria Vance. When I laid out the facts, showed her the saved copy of Karen’s video, the harassing text messages from my mother, and the school suspension records, Victoria actually laughed.

"This is not just a frivolous lawsuit, Mr. Davis," Victoria said, tapping her pen against her wooden desk. "This is a goldmine for a countersuit. Your sister posted a video of a minor child—your daughter—without consent, subjecting her to public ridicule and intentional infliction of emotional distress. Furthermore, her claims of defamation are entirely baseless because she was the one who published the evidence of her own misconduct."

"What do you recommend?" I asked.

"We file a motion to dismiss her lawsuit immediately, accompanied by a request for sanctions against her attorney for filing a baseless claim. Simultaneously, we file a civil countersuit for intentional infliction of emotional distress against your daughter, and we seek a formal Restraining Order against both Karen and your mother to keep them away from your family."

Hearing those words felt like putting on a suit of armor. For years, I had played defense against my sister’s aggression. Now, for the first time, I was playing offense.

Two weeks later, we met in a neutral conference room at the county courthouse for a court-mandated mediation session before a judge would hear the motion to dismiss.

Karen walked in wearing a poorly tailored suit, trying to look professional, but her eyes were bloodshot and erratic. My mother sat right beside her, holding her hand like a protective mother hen, glaring daggers at me. Karen’s court-appointed lawyer looked utterly miserable, clearly realizing he had taken on a client who was completely delusional.

I sat on my side of the table with Victoria. Sarah was there too, holding my hand tightly under the polished mahogany table.

"Let's make this quick," Victoria opened, sliding a thick blue folder across the table toward Karen's lawyer. "This folder contains three things. First, high-definition screen captures and downloaded video metadata of your client uploading the incident on her public social media profiles. Second, written statements from six parents who attended the party, testifying to your client's active encouragement of her son's destructive behavior. Third, a psychological evaluation from Lily’s child therapist detailing the regression and trauma caused by the incident."

Karen’s lawyer opened the folder, flipped through two pages, and visibly paled. He leaned over and whispered frantically into Karen’s ear.

"I don't care!" Karen snapped loudly, shoving her lawyer's hand away. "He ruined my life! He got me fired! He made the school kick Dylan out!"

"Your client got herself fired through her own public conduct, which violated her company's ethics policy," Victoria stated coldly. "Mr. Davis had zero communication with her employer. Furthermore, if you do not withdraw this ridiculous lawsuit within twenty-four hours, we will proceed with our countersuit for one hundred thousand dollars in damages for intentional infliction of emotional distress upon a six-year-old minor."

"You can't do that!" my mother shrieked, standing up so fast her chair scraped loudly against the floor. "He's your brother, Michael! You're going to bankrupt your own sister? Where is your heart?"

I looked at my mother, feeling neither anger nor sadness—only a deep, clear clarity.

"My heart is with my daughter, Mom," I said, my voice completely steady. "The daughter you stood by and allowed to be publicly humiliated. You made your choice years ago when you chose Karen's bad behavior over my well-being. And you made it again two weeks ago. Now you have to live with the consequences."

Karen looked at her lawyer, her eyes wide with sudden panic. "Can they do that? Can they take my money?"

Her lawyer closed the folder with a heavy sigh. "Karen, if this goes to a judge, you will lose. Badly. And you will be responsible for all of their legal fees, which are already in the thousands. I strongly advise you to withdraw the petition immediately and sign a mutual non-disparagement agreement."

The room fell completely silent. Karen looked at me, searching my face for the timid, submissive brother she had pushed around her entire life. But that boy was gone. In his place was a father who would stop at nothing to protect his family.

Sensing total defeat, Karen collapsed back into her chair, bursting into bitter, ugly tears. My mother wrapped her arms around her, glaring at me with pure hatred, but she said nothing more.

"We'll sign the withdrawal," Karen's lawyer whispered quietly.
